Laptop Battery State planners opted to protect nature over profits yesterday, denying Wal-Mart's plan to build a gas station at a Secaucus Sam's Club in what environmentalists saw as a test case for the new Meadowlands master plan.

Thinkpad Rejecting Sam's Club's argument that the store needs the gas station to compete with other big- box retailers, the six-member New Jersey Meadowlands Commission voted against the plan, ending an 11-month battle.
According to the indictment, Jones would steal various IBM and Penguin computer servers from Verisign's warehouse in Virginia and sell them to Johnson. Johnson would then sell the servers to several individuals, who would sometimes place them for sale on eBay. As a result of this scheme, the indictment alleges that Jones and Johnson caused Verisign to lose more than $120, 000 worth of computer equipment. In the indictment, Jones and Johnson are charged in three counts with causing the interstate transportation of stolen property, namely IBM 330 and 335 servers, in violation of 18 U.S.C.
Microsoft "The key here was upholding the integrity of the master plan," said commissioner Susan Bass Levin. "The commissioners are very concerned about the environmental impacts."

Laptop Computers Levin said gas stations are no longer permitted near the marshes by Sam's Club, under the agency's year-old master plan, hailed by environmentalists for its strict building regulations and vision to protect 8,400 acres of wetlands and waterways in the 14-town region in Hudson and Bergen counties.

Desktop Computer The Sam's Club gas station application was seen by environmentalists as a test of the commission, which is charged with weighing preservation against development needs in the region.
Notebooks Sam's Club representatives argued that the "fueling station" is not a regular gas station and should be considered an "auxiliary use," allowed under regulations for the site.
Lenovo The giant discount retailer, which has nine other locations in New Jersey, two with gas stations, likely will appeal the denial, said John Peter Suarez, vice president and general counsel for the company. Sam's Club wants to put the station in the parking lot at its store behind the Plaza at Harmon Meadow shopping center.
Hard Drive Kenneth McPherson Sr., a lawyer for Sam's Club, argued that denying the store's ability to sell cheap gas will hurt its ability to compete with Costco in Clifton, where customers can fill up at a discount.
Travelstar "It's about competition," McPherson said. He argued that customers have come to expect discount gas stations at big-box retailers and said there is proof of a trend because stations are now at roughly 60 percent of Costco stores, Sam's Clubs and BJ's across the country.
Gateway "I don't think it's so bad to introduce some competition, with the gas prices in today's world," McPherson said.
Laptop Parts The commissioners didn't buy the argument. Levin said the law forbids the agency from allowing new construction based exclusively on the desire of a company to make more money. And she said Sam's Club failed to show it would suffer economic hardship without the station.
Software "The Sam's Club is doing just fine," Levin said. "It shows no signs of economic hardship."
Hard Drives The decision, however, was a blow to Secaucus Mayor Dennis Elwell, who lobbied strongly for the station. He said Sam's Club representatives promised they would increase donations to town organizations from thousands of dollars to "tens of thousands" of dollars if they could get the station and draw more customers.
Electronics "I think I would not be serving my community if I didn't do everything I can to help the company's success," Elwell told the commissioners.
Canon Environmentalists applauded the denial. Michael Herson of the North Jersey chapter of the Sierra Club said gas stations close to the sensitive marshes are a recipe for ecological disaster.
Desktop Pc "We're trying to turn a corner in the Meadowlands," Herson said. "The Meadowlands are special, and could be a model for the Highlands," a broad, state-protected swath of northwestern New Jersey.
Desktop Computers Even the promise of lower gas prices -- as much as 10 cents lower per gallon -- could be shortsighted, argued William Dressler, executive director of the New Jersey Gasoline Retailers Association and Allied Trades.
