Take-Two Officially Under Investigation
Laptop Battery Gamespot reported some new developments in the "Hot Coffee" scandal today. Take-Two, the publisher behind Grand Theft Auto: San Andreas revealed that it is indeed already the subject of an FTC investigation. The other big story is that a civil lawsuit (sure to be the first of many) has been filed against the publisher.
First, the FTC is investigating the advertising behind GTA: San Andreas and to who it was targeted. The FTC is seeking to determine whether or not Take-Two purposely mislead the public in their promotion of the title. Take-Two issued a statement ensuring full cooperation and that they are sure the findings will indicate they obeyed all applicable laws.
As for the civil lawsuit, a woman named Florence Cohen filed the suit in New York just this morning, seeking more than $5 million in damages. Ms. Cohen claims to have been damaged as a result of learning about the sex-minigames in the title which she had bought for her grandson. The age of her grandson was not mentioned.
Ms. Cohen is seeking a court victory on four major points. She accuses publisher Take-Two of engaging in "Consumer Deception," "False Advertising," "Common Law Fraud" and "Unjust Enrichment." To simplify the legalese, Ms. Cohen is suing Take-Two for what she sees as lying about the content of the game.
