Court Orders Kazaa to Quit Music File Sharing

Dirty Downloading Downloading music from the Internet has replaced the record store as the place to pick up the latest tunes. While a godsend to music lovers, the songwriter' sharing services. Record companies are fighting back with a series of lawsuits against individual consumers who have obtained free music downloads from unauthorized online services such as Kazaa and Grokster. Napster, sharing evildoer, has gone legit. Since 2003, the Recording Industry Association of America (RIAA) has filed over 3000 lawsuits against students, families, and parents.

Thinkpad (AXcess News) Sydney Australia - A federal court has ordered Kazaa to fix its software effectively preventing its users from using the file-sharing system to download music.

The music industry fought the rise of MP3s every way it could, claiming that digital music files could only lead the copying of songs and increased piracy. Studios spent millions taking companies such as Napster and Sharman Networks Ltd., the company behind the Kazaa file sharing program, to court to keep people from downloading music.

Microsoft The recording industry brought the lawsuit against Kazaa and hailed it victory for musicians everywhere, saying it had global implications for the industry and others who use illegal programs to download songs.

Users can easily organize all of their music files, then transfer their play lists to another computer, or share them with friends, workers who are also running PCsync.

Laptop Computers The US Supreme Court had ruled in June that the music industry could suetechnology companies who illegally steal music on the Internet. Hollywood also benefited from the ruling as the court included movies in its decision.

Though primarily used to trade music, Peer to Peer software could be used to share any types of files, images, sounds and even computer programs.

Laptop Computer Judge Murray Wilcox ruled Monday that Kazaa and its owners and distributors, led by Sharman Networks Ltd, did nothing to prevent Kazaa users from downloadingillegal music files, despite postings on Kazaa's website urging users not to swap copyright materials.

Desktop Computer Judge Wilcox said it was in Sharman's best financial interest not to prevent users from downloading illegal music files.

Notebooks The Federal Court found six of the ten defendants guilty, which included Sydney-based Sharman chief executive NIkki Hemming, guilty of copyright infringementand ordered the six defendants to pay 90 percent of the music industry's costs in the landmark case.

Lenovo Judge Wilcox will schedule a separate hearing to assess damages in the case.

Hard Drive A spokesperson for the Australian recording industry said they would ask the court to reflect the losses incurred by the music industry on all of the illegal file swapping Kazaa and Sharman Network Ltd in assessing damages.

Travelstar Kazaa and Sharman said they would appeal the case and that its file-sharing software would remain online pending that appeal. Last week alone over 800,000 downloads were reported, adding to the 390 million so far this year.

Gateway Sharman and Kazaa liken their file-sharing program to that of a tape recorder, saying they have no control over its use. But Wilcox had said that Sharman had encouraged users to download illegal music files to its monetary benefit, the vast majority of which were copyrighted materials.

Laptop Parts Judge Wilcox said that if Kazaa is to survive it will have to fix its file sharing software to filter out uncopyrighted materials, which he believed would be difficult to address.

Software The judge said that he did not want his ruling to affect legitimate file sharing that otherwise may infringe on user freedom of speech and communications.
