Thinkpad (AXcess News) Austin TX - Prosecution witnesses in the DeLay hearing for a motion to move the powerful Texas politician's case out of Travis County gave testimony Monday citing reasons why they believed Rep. Tom DeLay would receive a fair trial there. DeLay's attorneys argued that Delay, who is facing money laundering and conspiracy charges in Travis County, would be prejudiced by the court in that jurisdiction and want the trial moved.
According to the indictment, Jones would steal various IBM and Penguin computer servers from Verisign's warehouse in Virginia and sell them to Johnson. Johnson would then sell the servers to several individuals, who would sometimes place them for sale on eBay. As a result of this scheme, the indictment alleges that Jones and Johnson caused Verisign to lose more than $120, 000 worth of computer equipment. In the indictment, Jones and Johnson are charged in three counts with causing the interstate transportation of stolen property, namely IBM 330 and 335 servers, in violation of 18 U.S.C.
Microsoft Travis County is at the heart of the complaintafter the countywas split into three different congressional districts as a result of a redistricting map DeLay engineered. The prosecution has said that much of the funding to political campaigns there were manipulated to appear as if they were legitimate by moving the cash into and out of Washington DC first. DeLay's attorneys have argued that the defendant would be "vilified" if the trail were held there.

Laptop Computer Dick DeGuerin said state law mandates this type of case be returned to the home county of the accused. That would put the trial in Fort Bend County, outside of Houston. DeGuerin is DeLay's lawyer in the money laundering and conspiracy case.
In such cases, the men were most likely to be living at the time of Attestation in or adjacent to the county whose militia they had volunteered for.
Desktop Computer Betty Blackwell, a prominent Austin attorney, gave an affidavit in behalf of the prosecution Monday in which she stated, "There is not so great a prejudice against the defendant, nor is there a dangerous combination of any sort, that will interfere with him receiving a fair trial in Travis County."
Notebooks DeLay had to step down from his GOP post after money laundering and conspiracy charges were levied against the powerful Republican politician. The prosecution has argued that campaign money contributed by corporations was donated to Texas politicians running for the state Legislature. Texas law does not allow the direct use of corporate money for campaigning.
Lenovo While DeGuerin was able to get a different judge, moving the case out of Travis County appears to be a long shot as DeGuerin will have to prove to Judge Priest that Delay would be prejudiced. So far, the prosecution is doing a better job of proving the defendant is being treated fairly there.
