Microsoft Priest notified DeLay's attorneys by e-mail Saturday that the money laundering charge was on hold pending Earl's appeal.
According to the indictment, Jones would steal various IBM and Penguin computer servers from Verisign's warehouse in Virginia and sell them to Johnson. Johnson would then sell the servers to several individuals, who would sometimes place them for sale on eBay. As a result of this scheme, the indictment alleges that Jones and Johnson caused Verisign to lose more than $120, 000 worth of computer equipment. In the indictment, Jones and Johnson are charged in three counts with causing the interstate transportation of stolen property, namely IBM 330 and 335 servers, in violation of 18 U.S.C.
Laptop Computers DeLay's lawyers had petitioned to have the charges against DeLay seperated into two seperate trials so conspiracy charges could move through the courts quickly. But a hearing which was to be held December 27 has been canceled.

Laptop Computer DeLay's lawyer, Dick DeGuerin, told reporters he was surprized by the news but also said he plans on filing a response Monday in both courts, asking that the appeal be dismissed and requesting a speedy hearing.

Desktop Computer DeGuerin believes that Earl's appeal is "frivolous", in that its a stall tactic to delay DeLay's trail.
Notebooks Earl did not respond to DeGuerin's accusations.
Lenovo Tom DeLay was indicted on the conspiracy charge September 28. A second grand jury handed down the money-laundering indictment five days later.

DeLay, who held the House Majority Leader's seat in Congress, was forced to step aside once the charges were brought against him. If found guilty, DeLay would be facing a prison sentence and his career in politics would be over. DeLay has been the representative for his Houston district in Texas since 1985.
