Laptop Battery J. Garfield DeMarco is kept busy these days fighting his older brother for control of the family business, negotiating with creditors to stave off foreclosure and finalizing a deal to sell nearly 10,000 acres of his cranberry bogs to a conservation group.
J. Garfield DeMarco filed the lawsuit against Ocean Spray in a Delaware Chancery Court on Thursday. DeMarco's attorney in the case, H. Robert Fiebach of Philadelphia, could not be reached for comment yesterday afternoon. However, an Ocean Spray spokesman yesterday said that DeMarco's lawsuit essentially seeks to force the growers cooperative to explore a possible sale. "The gist of it is that they want to push again for the sale of the company, which is a minority position, " Ocean Spray spokesman Chris Phillips said.
Thinkpad But for the second year in a row, the 64-year-old's family business, A.R. DeMarco Inc., has not farmed its cranberry bogs in and around Chatsworth, the southern Burlington County town in the heart of the Pinelands.
DeMarco is an Ocean Spray stockholder, a former member of the company's board of directors and president of A.R. DeMarco Enterprises Inc. the third largest grower in the Ocean Spray cooperative, which includes more than 800 growers in the United States and Canada.
Microsoft Unless the company starts harvesting, however, DeMarco might have to give up his shares in Ocean Spray, the country's biggest cranberry drink maker, according to rules that govern the cooperative.
The white cranberries are harvested roughly three weeks earlier than usual, before they turn the traditional crimson color. Right now, Ocean Spray growers are harvesting the white cranberries in Wisconsin, Massachusetts and parts of southern New Jersey, including Burlington County. "For us, it's worth doing, " said Joe Darlington, an Ocean Spray grower who is harvesting white cranberries on his farm in Pemberton Township.
Laptop Computers DeMarco is one of about 750 cranberry and 150 citrus growers who own shares in the Massachusetts-based Ocean Spray cooperative. A former member of the Board of Directors, DeMarco is among Ocean Spray's most powerful shareholders, according to court records.

Laptop Computer DeMarco, the former Burlington County Republican Party chair, controls about 3 percent of Ocean Spray.
According to the indictment, Jones would steal various IBM and Penguin computer servers from Verisign's warehouse in Virginia and sell them to Johnson. Johnson would then sell the servers to several individuals, who would sometimes place them for sale on eBay. As a result of this scheme, the indictment alleges that Jones and Johnson caused Verisign to lose more than $120, 000 worth of computer equipment. In the indictment, Jones and Johnson are charged in three counts with causing the interstate transportation of stolen property, namely IBM 330 and 335 servers, in violation of 18 U.S.C.
Desktop Computer But shares in Ocean Spray are based on how much a grower produces, and DeMarco has not been growing at all. Ocean Spray officials declined to say how long shareholders can stop growing before they must leave the coop.
Notebooks Shares are adjusted every three years to account for changes in production. Ocean Spray officials also are not saying when that adjustment will take place next.
Lenovo On the surface, then, it would seem that DeMarco's days in Ocean Spray are numbered.
Hard Drive DeMarco already has agreed to sell most of his bogs to a northern New Jersey conservation group, The New Jersey Conservation Foundation.
Travelstar However, A.R. DeMarco Inc.'s corporate attorney Mark Blaskey said DeMarco could continue farming even after the sale. He said DeMarco has not decided whether to start harvesting again next year.
Gateway A provision in the $12 million sale agreement allows DeMarco to continue farming his cranberry bogs for two years after the closing date. Closing has been set for Sept. 2.
Laptop Parts DeMarco's older brother, Mark, had sought to block the sale. He filed a lawsuit earlier this year alleging that Garfield was squandering corporate funds on lavish meals and maintenance on his Mercedes Benz sedans.
Software Mark later decided to allow the sale to move forward, but he still wants a court-appointed trustee to control the company's finances.
Hard Drives Superior Court Judge George Seltzer denied that request for now, saying the issue should be left to a jury.
Electronics The judge, however, granted the financial corporate documents Mark DeMarco sought. The judge also increased oversight over company spending.
Canon In the same lawsuit, Mark DeMarco, 74, is also suing his sister, Anna Lynne Papinchak, who lives in Washington state.
Desktop Pc Each of the three - Mark, Garfield and Anna - owns a one-third stake in the company.
Desktop Computers Mark claims Anna sides with Garfield and serves as his "rubber stamp," according to court papers.
Think Pad Mark, who has been hospitalized with undisclosed health problems since December, accuses Garfield of using corporate funds on political contributions, lavish meals, Mercedes Benz repairs and limousines.
Repair In legal documents calling for a court-appointed corporate trustee, Mark DeMarco paints a grim picture of the company's financial state. He said A.R. DeMarco Inc. owes more than $6 million in loans, taxes and IRS settlement payments.
