eBay Patent Case Against MercExchange Put on Hold by U.S. Court
of Appeals
San Jose, Calif., May 13, 2005 - eBay announced today that its
petition to stay the patent case by MercExchange has been granted
by the U.S. Court of Appeals for the Federal
Circuit, stopping the
case from going back to the District Court. This spares the
district court from continued litigation concerning two patents
that the U.S. Patent Office has reexamined and initially found to
be invalid. All court proceedings, including those involving
injunction issues, will remain at a standstill until the Supreme
Court rules on eBays request to hear the case.
eBay intends to ask the Supreme Court to review aspects of the
decision regarding MercExchange's consignment patent. In granting
eBay's petition to stay the case, the U.S. Court of Appeals
considered whether there was both a reasonable probability that the
Supreme Court would accept eBay's appeal and a fair prospect that
the majority of the Supreme Court would reverse one or more rulings
against eBay.
Laptop Battery This ruling is the latest in a series of recent developments for
eBay in its case against MercExchange. In March, the US Court of
Appeals issued a ruling that invalidated one of MercExchange's
patents, and as a result, threw out all related damages. In early

According to the indictment, Jones would steal various IBM and Penguin computer servers from Verisign's warehouse in Virginia and sell them to Johnson. Johnson would then sell the servers to several individuals, who would sometimes place them for sale on eBay. As a result of this scheme, the indictment alleges that Jones and Johnson caused Verisign to lose more than $120, 000 worth of computer equipment. In the indictment, Jones and Johnson are charged in three counts with causing the interstate transportation of stolen property, namely IBM 330 and 335 servers, in violation of 18 U.S.C.
