Witness For DuPont Discounts Plaintiffs' Study On Toxins

Laptop Battery An epidemiologist for DuPont said he has "no faith" in findings that chemicals from the company's closed munitions plant in Pompton Lakes is linked to a high cancer rate in the Passaic County town.

According to the indictment, Jones would steal various IBM and Penguin computer servers from Verisign's warehouse in Virginia and sell them to Johnson. Johnson would then sell the servers to several individuals, who would sometimes place them for sale on eBay. As a result of this scheme, the indictment alleges that Jones and Johnson caused Verisign to lose more than $120, 000 worth of computer equipment. In the indictment, Jones and Johnson are charged in three counts with causing the interstate transportation of stolen property, namely IBM 330 and 335 servers, in violation of 18 U.S.C.

Thinkpad Harris Pastides, an expert for DuPont who testified during the fourth week of the much-anticipated environmental trial against the company in Passaic County Superior Court, said the epidemiological study presented by the residents suing the company made "significant departures" from science.

Microsoft Also testifying for DuPont yesterday was the chairman of the Pompton Lakes Municipal Utilities Authority, who said the drinking water in the Passaic County town has consistently met state safety standards for chemical contaminants since he began working there 17 years ago.

Desktop Computer In his testimony yesterday, Pastides, a professor of epidemiology at the University of South Carolina, criticized the testimony of the plaintiffs' star witness, Dr. James Dahlgren, an expert in environmental medicine from California who once testified in the contamination case made famous in the movie "Erin Brockovich."

Notebooks Dahlgren told the 14-member jury two weeks ago that the plaintiffs' epidemiological study showed the cancer rate in Pompton Lakes is more than four times higher than the national average. He also said the cancer rate for younger residents is abnormally high -- sixteen times higher than the rate in a control group in Arizona.

Lenovo But Pastides, who studies the prevalence and prevention of illness in populations, said Dahlgren's study was flawed because the group of Arizona residents he used as a sample was so far away geographically that the residents were not similar enough to Pompton Lakes residents for a scientific comparison. He also said the study is flawed because the 1,700-member study group used in Pompton Lakes were all people suing DuPont, and therefore not a random sample, which he said is necessary in his field of science.

Hard Drive "I believe that based on these two very significant departures from the science of epidemiology, that I have no faith in his study," Pastides said.

Travelstar Pastides also said the plaintiffs' studies lacked the "reliable estimates of chemical exposure" necessary to scientifically conclude that DuPont's contaminants caused the residents' ailments.

Gateway On cross-examination by the plaintiffs' lawyer, Paul Garelick, however, Pastides admitted he had not examined any of the plaintiffs, that he had never visited the DuPont site or done any analysis of the toxic effects of the chemicals used at the plant. He also said he has performed much consultant work for large chemical companies.

Laptop Parts In other testimony yesterday, George Decker, chairman of the Pompton Lakes Municipal Utilities Authority Board, said levels of chlorinated solvents, mercury, lead and other contaminants found in the town's drinking water over the past 17 years were all below the state Department of Environmental Protection's "maximum contamination level" set for safe drinking water standards.

Software On cross-examination, however, Decker said that some levels of trichloroethane, trichloroethylene, and other organic solvents used at DuPont were discovered in the municipal well closest to the plant site virtually every year since 1985.

Hard Drives In earlier testimony, experts for the plaintiffs said it was the combined effect of the various chemicals found in trace amounts in the drinking water that was linked to cancer and other illness in Pompton Lakes residents.

Electronics The plaintiffs' lawyers argued that Decker has a credibility problem because his family accepted $8,000 from DuPont as part of a 1998 settlement in which DuPont paid $38.5 million to 427 Pompton Lakes adults and children who claimed health problems from the contamination.

Canon Judge Frank Donato, however, decided not to allow the jury to hear about the settlement because it had "minimal relevance and considerable prejudice" in the case. The lawyers in the case are barred from discussing the earlier settlement in the current trial.

Desktop Pc The first phase of the trial, expected to last until the start of June, is featuring only 10 people presenting individual claims against DuPont. The suit seeks compensation for any medical expenses for residents who are ill and $80 million for long-term health monitoring of people who were allegedly exposed to toxins.
